Rafl.ai Monthly Pooled Sweepstakes

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED. OPEN ONLY TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES AND THE DISTRICT OF COLUMBIA WHO ARE EIGHTEEN (18) YEARS OF AGE OR OLDER AT THE TIME OF ENTRY.

These Official Rules govern the monthly sweepstakes promotions administered by Rafl.ai and sponsored by participating ecommerce merchants through the Rafl.ai platform.

1. Sponsor and Administrator

Each monthly sweepstakes is sponsored by Rafl.ai, d.b.a of Boggs Holdings LLC, 4411 Putting Green Drive, Corona, CA 92883 (“Sponsor” or “Administrator”), together with participating ecommerce merchants identified on the applicable promotion page. Rafl.ai administers the monthly pooled sweepstakes and may collect funds, operate the promotion infrastructure, maintain the entry records, conduct the drawing, verify winners, and arrange prize fulfillment.

For each monthly sweepstakes, the applicable promotion landing page will identify:

  • the month of the promotion,
  • the participating merchants, if applicable,
  • the total prize amount or prize description,
  • the entry start and end dates,
  • the drawing date or approximate drawing date, and
  • the specific AMOE page and any supplemental disclosures.

2. Agreement to Official Rules

By participating, each entrant fully and unconditionally agrees to these Official Rules and the decisions of Sponsor, which are final and binding in all matters relating to the sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.

3. Eligibility

The sweepstakes is open only to:

  • legal residents of the fifty (50) United States and the District of Columbia;
  • who are at least eighteen (18) years of age or the age of majority in their state of residence, whichever is older, at the time of entry; and
  • who comply with these Official Rules.

The sweepstakes is not open to residents of U.S. territories, foreign jurisdictions, or any jurisdiction where the promotion is prohibited or restricted by law.

The following persons are not eligible:

  • employees, officers, directors, managers, members, agents, and representatives of Sponsor, Rafl.ai, participating merchants, and each of their parent companies, subsidiaries, affiliates, advertising agencies, promotion agencies, prize suppliers, and service providers;
  • immediate family members of such persons, including spouse, parent, child, sibling, grandparent, and step-relations; and
  • individuals living in the same household as such persons, whether related or not.

4. Sweepstakes Period

Rafl.ai runs monthly pooled sweepstakes. Each sweepstakes begins at the time and date listed on the applicable monthly promotion page and ends at the time and date listed thereon (“Sweepstakes Period”). Sponsor’s computer, database, and server systems are the official timekeeping devices for the sweepstakes.

Entries submitted before or after the applicable Sweepstakes Period will not be eligible.

5. How to Enter

Entrants may enter the sweepstakes during the applicable Sweepstakes Period through one of the methods described below.

A. Purchase-Based Entry

An eligible entrant may receive entries in connection with qualifying activity with a participating merchant, such as a qualifying purchase, as described in the applicable monthly promotion materials.

B. Free Alternative Method of Entry (AMOE)

Entrants may also enter without making a purchase through the free Alternative Method of Entry (“AMOE”), which will be described on a separate AMOE page linked from the promotion. The AMOE page is incorporated into these Official Rules by reference.

No purchase is necessary to enter or win. A purchase will not increase an entrant’s chances of winning.

All AMOE entries must be submitted in accordance with the instructions and deadlines stated on the applicable AMOE page.

C. Equal Treatment of Entries

All valid entries, whether earned through a qualifying purchase path or submitted through the AMOE path, will be treated equally for purposes of the random drawing, subject to the entry limits described below. The Sponsor intends for the sweepstakes to be operated as a lawful sweepstakes and not as an illegal lottery by providing a free method of entry and equal chance to win.

6. Entry Limits

Unless otherwise stated on the applicable monthly promotion page, there is a maximum of five hundred (500) total entries per person per monthly sweepstakes, regardless of method of entry.

Entry limits apply across all entry methods combined. Any attempt by any entrant to obtain more than the stated limit by using multiple email addresses, identities, devices, automated systems, aliases, scripted entries, or any other means may result in disqualification, in Sponsor’s sole discretion.

7. Entry Conditions and Prohibited Conduct

Only complete, legible, and valid entries are eligible. Sponsor may disqualify any person who:

  • tampers with the entry process or operation of the promotion;
  • uses bots, scripts, macros, automation, or similar methods;
  • provides false, incomplete, misleading, or fraudulent information;
  • attempts to exceed the entry limit;
  • violates these Official Rules;
  • engages in abusive, deceptive, or unlawful conduct; or
  • acts in a manner that could damage the integrity or reputation of the sweepstakes, Sponsor, or any participating merchant.

Sponsor is not responsible for lost, late, misdirected, corrupted, incomplete, illegible, delayed, garbled, inaccessible, or technically malfunctioning entries.

8. Prize

For each monthly pooled sweepstakes, the prize or prizes, including the total prize value and the approximate retail value (“ARV”), will be stated on the applicable monthly promotion page.

Unless otherwise stated:

  • prizes are awarded “as is”;
  • no substitution, assignment, or transfer of a prize is permitted except by Sponsor;
  • Sponsor reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable for any reason;
  • if a cash prize is offered, payment may be made by check, ACH, electronic transfer, digital payment service, or another commercially reasonable method selected by Sponsor

9. Winner Selection

At the end of each Sweepstakes Period, Sponsor will select the potential winner or winners in a random drawing from among all eligible entries received for that monthly sweepstakes.

The drawing will be conducted on or about the date stated on the applicable monthly promotion page.

Odds of winning depend on the total number of eligible entries received during the applicable Sweepstakes Period.

10. Winner Notification and Verification

The potential winner will be notified using the contact information associated with the winning entry, which may include email, telephone, or another contact method provided at entry.

Before a prize is awarded, the potential winner may be required to:

  • confirm eligibility;
  • sign and return an Affidavit of Eligibility;
  • sign and return a Liability Release and, where lawful, a Publicity Release;
  • provide government-issued identification;
  • provide a completed IRS Form W-9 for prizes of $600 or more, or where otherwise required;
  • provide payment delivery details; and
  • complete any other reasonable verification steps required by Sponsor.

If a potential winner:

  • cannot be contacted,
  • fails to respond within the time period specified by Sponsor,
  • fails to provide required documentation,
  • is found to be ineligible, or
  • otherwise fails to comply with these Official Rules,

then that potential winner may be disqualified and an alternate winner may be selected in Sponsor’s discretion.

Cash prizes of $600 or more generally require tax reporting on Form 1099-MISC.

11. Taxes

All federal, state, and local taxes associated with receipt or use of a prize are the sole responsibility of the winner.

If required by law, Sponsor will issue the winner an IRS Form 1099-MISC or other required tax form for the actual value of the prize awarded. The winner must provide any information reasonably required for tax reporting, including a valid taxpayer identification number.

12. Publicity Release

Except where prohibited by law, acceptance of a prize constitutes the winner’s permission for Sponsor, Rafl.ai, and participating merchants to use the winner’s name, city/state of residence, likeness, voice, statements, and prize information for advertising, publicity, and promotional purposes in any media now known or later developed, worldwide, without additional compensation, notice, review, or approval.

13. Privacy

Information collected in connection with the sweepstakes is subject to the applicable privacy policies of Rafl.ai and, where applicable, the participating merchant. Information may be used for administration of the sweepstakes, winner verification, fraud prevention, tax reporting, customer support, legal compliance, and marketing communications where permitted by law and based on the entrant’s consent choices.

14. Release of Liability

By participating, each entrant agrees to release, discharge, and hold harmless Sponsor, Rafl.ai, participating merchants, Shopify, and each of their respective parent companies, subsidiaries, affiliates, advertising and promotion agencies, prize suppliers, directors, officers, employees, agents, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, or expenses arising out of or relating to:

  • participation in the sweepstakes;
  • acceptance, possession, use, misuse, or non-use of any prize;
  • technical failures of any kind;
  • unauthorized human intervention;
  • electronic or human error in the administration of the sweepstakes; or
  • any injury, loss, or damage to person or property.

15. Limitation of Liability

Sponsor is not responsible for:

  • incorrect or inaccurate entry information;
  • interrupted or unavailable network, server, platform, or website access;
  • failed, incomplete, or delayed communications;
  • technical malfunctions of any kind;
  • typographical, printing, programming, or other errors;
  • unauthorized access to, or tampering with, entries or personal information; or
  • any force majeure event, including natural disaster, pandemic, war, terrorism, civil disturbance, labor strike, governmental action, or other event outside Sponsor’s reasonable control.

If, for any reason, the sweepstakes cannot be conducted as planned, Sponsor reserves the right, in its sole discretion, to cancel, suspend, or modify the sweepstakes and, if appropriate, select winners from among eligible, non-suspect entries received before the event requiring such action.

16. Sponsor’s Right to Disqualify / Cancel / Modify

Sponsor reserves the right in its sole discretion to disqualify any entrant it finds to be:

  • acting in violation of these Official Rules;
  • attempting to undermine the legitimate operation of the sweepstakes;
  • acting in an unsportsmanlike or disruptive manner; or
  • acting with the intent to annoy, abuse, threaten, or harass any other person.

Sponsor also reserves the right to cancel, suspend, or modify the sweepstakes if fraud, technical failures, legal changes, or any other factor impairs the integrity, security, fairness, or proper administration of the sweepstakes.

17. No Endorsement by Shopify or Other Platforms

The sweepstakes is sponsored and administered by Rafl.ai and, where applicable, participating merchants. The sweepstakes is not sponsored, endorsed, administered by, or associated with Shopify, nor by Meta, Google, Klaviyo, Mailchimp, or any other third-party platform unless expressly stated otherwise in writing.

18. Governing Law and Disputes

Except where prohibited, all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of entrants and Sponsor, shall be governed by the laws of the State of [Insert Governing State], without giving effect to any choice-of-law or conflict-of-law rules.

By entering, each entrant agrees that:

  • any dispute, claim, or cause of action arising out of or relating to the sweepstakes shall be resolved individually, without resort to any form of class action;
  • any such dispute shall be brought exclusively in the state or federal courts located in [Insert County/State]; and
  • entrant submits to the personal jurisdiction of those courts.

To the fullest extent permitted by law, entrants waive all rights to claim punitive, incidental, consequential, or indirect damages, and any right to have damages multiplied or increased, except for actual out-of-pocket costs incurred to enter the sweepstakes, if any.

19. State-Specific Compliance

Sponsor intends to operate each monthly sweepstakes in compliance with applicable federal and state law. However, certain states impose additional registration or bonding requirements in some circumstances.

For example:

  • New York requires registration for chance-based promotions connected to the sale of consumer products or services when prizes offered exceed $5,000.
  • Florida requires certain game promotions with prizes totaling more than $5,000 to be filed in advance.
  • Rhode Island has registration rules for certain retail promotions with prizes over $500, particularly retail-related promotions.

Where a particular monthly sweepstakes triggers registration, bonding, filing, posting, or other state-specific legal requirements, Sponsor reserves the right to:

  • limit eligibility,
  • exclude residents of certain jurisdictions,
  • modify the promotion structure,
  • delay launch pending filing approval, or
  • take any other action reasonably necessary to comply with law.

Any such modifications will be disclosed on the applicable monthly promotion page or in an addendum to these Official Rules.

20. AMOE Terms

The official Alternative Method of Entry (AMOE) is described on a separate page linked in the promotion materials. That AMOE page is incorporated into these Official Rules by reference. In the event of a conflict between these Official Rules and the AMOE page, these Official Rules control unless the AMOE page expressly states otherwise for the applicable monthly promotion.

21. Severability

If any provision of these Official Rules is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.

22. Winner List

To request the name of the winner for a particular monthly sweepstakes, send a written request to:

Requests must identify the applicable monthly sweepstakes and be received within thirty (30) days after the applicable drawing date. Sponsor may respond by email, website posting, or other reasonable method, subject to privacy, publicity, and legal considerations.

23. Entire Agreement

These Official Rules, together with the applicable monthly promotion page, prize disclosures, AMOE page, and Rafl.ai Privacy Policy, constitute the entire agreement between entrant and Sponsor relating to the applicable sweepstakes.
